Term insurance, being the simplest type of life insurance policy, provides life cover to an individual for a certain period in return of regular payment of a specific premium. Term insurance premium payments are eligible for tax benefits under Section 80C of the Income Tax Act, 1961..

Under current tax rules, individuals can reduce their taxable income by up to Rs. 1.5 Lakh annually for the term insurance premiums paid, if they have opted for the old tax regime. The benefit u/s 80C up to the annual Rs. 1.5 lakh cumulative limit also applies to contributions made towards other investments like the Public Provident Fund (PPF), tax-saving FDs, and more.

Traditionally, Indians focused on term insurance tax exemption when purchasing insurance. But this has changed now. Tax benefits are not the only reason behind the popularity of term policies. People buy these plans due to the life cover benefit that also helps them secure their families’ future.

Significant Facts Related to Term Insurance Tax Benefits U/S 80C
  • The annual premiums you pay for a term insurance plan must not exceed ten percent of the chosen sum assured. If it does exceed otherwise, term insurance tax benefits under Section 80C will be applied proportionately.
  • For term insurance plans issued before March 31, 2012, the term insurance benefits in income tax are applicable if the annual premium is under twenty percent of the sum assured.

Section 80D – Tax Deduction for Health-related Riders Only

Under section 10(10D) of the Income Tax Act, the death benefit received by the nominee or the beneficiary of the policy is generally not taxable. The policy ,must meet the criteria laid down in the Income Tax Act. This exemption forms an important part of the tax advantages associated with term insurance plans.

Here are some additional details regarding eligibility for term insurance tax benefits under Section 10(10D):

  • Core Eligibility Conditions: The most important eligibility criterion is that the policy should comply with the premium-to-sum-assured ratio and other premium-related conditions prescribed by the law. Further, the policy should be in effect when the claim occurs. If these requirements are met, the full amount paid can be tax-free.
  • Non-Compliance and Loss of Exemption: If the policy does not meet the statutory requirements, then the maturity or claim amount may lose its exempt status and be taxable. This can occur when the premium is more than the allowable ratio or if the policy is not renewed for non-compliance.
  • Exceptions for Specialised Policies: Certain types of insurance policies, such as Keyman insurance or employer-owned life insurance policies, may have varying taxation rules. In such situations, the benefits received will not necessarily qualify for exemption under Section 10(10D).

Section 10(10D) – Tax Exemption on Policy Payouts

Other than the term insurance tax benefits that the life insured can avail, he/she and the family members can also save money with tax exemptions. This is covered under Section 10(10D).

In simpler words, the death benefit or maturity benefit received under the term insurance policy is tax-exempt. This is also subject to various conditions provided therein. In general, these term insurance tax benefits have no upper limit. It means the entire amount that you or your loved ones will receive under the term plan is exempt from taxes.

As a term insurance policyholder, you should know that term insurance tax benefits under Section 10(10D) is also subject to certain conditions. It states that the maturity or death benefits under a term plan are non-taxable if the premium payable during the policy period does not exceed 20% of the pre-defined sum assured.

Tax Benefits on Term Insurance Riders

Various term insurance riders are offered by insurance companies to provide supplementary coverage. However, their benefits are not limited to strengthening a term insurance policy beyond its core features.

Depending on the rider you select with a term plan and related conditions, you can avail additional term insurance tax benefits but only if you have opted for the old tax regime. Here are a few ways in which term plan riders can make you avail additional term life insurance tax benefits:


  • Critical Illness rider, when added to your term plan, makes you eligible for tax deductions under Section 80D.

Exclusions Under Section 80D of the Income Tax Act

You can avail a tax deduction under Section 80D, in addition to 80C deductions, against the premium paid for your term plan if you include a health-related rider, such as personal accident cover. However, there are specific exclusions, such as:

  • Employer-Paid Group Health Insurance: If your employer pays the premium for a group health insurance policy, you cannot claim a deduction under Section 80D. The deduction is permissible only when you pay the premium.
  • Premium Paid in Cash: You cannot avail tax deduction under Section 80D against premiums paid in cash. You must pay the premiums either online or via cheques/demand drafts.
  • Premium Not Paid in the Financial Year: You can avail 80D deductions in a financial year only if you paid the premiums in the same year. If no premium is paid in one financial year, no deduction is allowed for that year.
  • Premium Paid for Ineligible Relatives: You can Section 80D deductions against premiums paid only policies that cover yourself, along with your spouse, and dependent children and parents. Hence, no deductions allowed for premiums paid for siblings, grandparents, uncles, aunts, or other relatives.

Payments Eligible for Deductions Under Section 80D

As already mentioned earlier term insurance tax benefits extend to specific riders and the critical illness rider offers tax benefits under Section 80D of the Income Tax Act (under the old tax regime). However, the tax benefits under Section 80D are not limited to only this. This section of the Income Tax Act offers tax benefits on the premium paid for a range of policies such as mediclaim, cancer insurance plans as well as various health insurance plans such as Axis Max Life Secure Earnings and Wellness Advantage (SEWA) plan.

However, it should be kept in mind that the tax benefit under Section 80D is limited to the actual payment made as well as limits that are specified under the Income Tax Act. GST on Term Insurance Premiums and Its Impact on Tax Deductions

Previously, term insurance policies were charged 18% GST for individual policies and 18% group premiums, effectively raising the cost for the policyholder annually. For example, an annual premium of Rs 20,000 increased to Rs 23,600 after including GST. This extra tax amount significantly increased the total cost of the insurance coverage over a long-term policy.

Many policyholders also ask: Is GST on term insurance eligible for 80C deduction? In general, the GST charged on eligible term insurance premiums will be reflected in the premium amount eligible for deduction under Section 80C of the Income Tax Act, 1961, as per applicable tax laws and the deduction limits.

How Much Tax Can You Save With Term Insurance?

Here are some illustrations that help you understand the tax benefits under different sections of the Income Tax Act applicable to a term insurance policy:

Section 10(10D)

Mr. Ramesh opted for a term insurance policy on 31st July 2015, with a premium of ₹40,000/year and the total sum assured of ₹5,00,000. Here, the policy is taken after 1st April 2012. Therefore, the premium paid does not exceed the 10% limit of the actual sum assured for claim deductions under section 10(10D) of the Income Tax Act. The annual premium paid is around 8% of the actual sum assured. Hence, the maturity amount is entirely exempt from taxation under section 10(10D).

Term Insurance Benefits under Section 10(10D)

Section 10(10D) (Section 11 - read with Schedule II, Sr. No. 2 under IT Act 2025) exempts the beneficiary from paying taxes on term insurance death benefits. This exemption is applicable to all types of individuals, including salaried and self-employed individuals.

No. The validity of a term insurance plan is essential to allow you to avail term insurance tax benefits. It means you are not allowed to skip paying the premiums to save income tax.

What will happen on not paying the premium on time?

If your term insurance premium falls overdue, you get a grace period to pay it up. Once the premium is paid within this period, there is no risk to any benefits related to the policy, including the term insurance tax benefits.

While in the case of unit linked plans, this is applicable if the annual premium paid is less than ₹2.5 lakh.

What is the deduction limit for non‑senior (ordinary) taxpayers under Section 80D?

For non-senior (ordinary) taxpayers (aged below 60), the maximum deduction allowed under Section 80D is ₹25,000 for a financial year (under the old tax regime). This deduction primarily covers health insurance premiums for the taxpayer, their spouse, and dependent children, along with preventive health check-ups up to ₹5,000 within the specified threshold.

Who qualifies to claim term plan tax benefits on premiums?

Individuals, including salaried employees, self-employed persons, and Hindu Undivided Families (HUFs), can claim tax benefits under Section 80C (old regime) against term insurance premiums. However, one of the following conditions must be true:

  • They have Indian citizenship,

When the policyholder faces a delay in the disbursal of the death benefit after the death of the insured, the insurer has to pay the sum assured along with applicable interest. In this case, the beneficiary is liable to pay taxes on the interest paid.

Can senior citizens claim higher deductions on term insurance riders?

Yes, senior citizens can claim higher deductions of up to ₹50,000 annually under Section 126 of the Income-tax Act, 2025, against health insurance premiums, including additional riders. However, it is only applicable under the old tax regime.

In case customer requests for cancellation of rider only, the solution as a whole will be cancelled and not just the individual rider.
