At GS Diamonds, we want you to feel confident in your purchase. That is why we offer a 30-day money-back guarantee on eligible items, in addition to your rights under the Australian Consumer Law.

 

1. Parties, Definitions and Interpretation

1.1 This 30-Day Money-Back Guarantee ("Guarantee") is provided by GS Diamonds Pty Ltd (ACN 063 429 050) ("GS Diamonds", "we", "us", or "our").

1.2 In this Guarantee, "you" or "your" means the individual purchaser of an item from GS Diamonds.

1.3 "Custom Made" means any item that has been altered, customised, resized, engraved, modified, or otherwise changed from its original design, whether at the time of purchase or at any time after purchase.

1.4 "Eligible Item" means an item supplied by GS Diamonds that satisfies all eligibility requirements set out in this Guarantee.

1.5 This Guarantee applies only to purchases made on or after 15 July 2024.

1.6 This Guarantee is provided in addition to any rights or remedies available to you under the Australian Consumer Law or any other applicable law.

2. Scope of Guarantee

2.1 Subject to the terms of this Guarantee, GS Diamonds may provide a refund for an Eligible Item where a valid claim is made within 30 days from the date on which the Eligible Item is collected by, or delivered to, you.

2.2 This Guarantee applies only to Eligible Items purchased by individual Australian residents.

2.3 This Guarantee does not apply to defective items. Defective items are dealt with separately under the Australian Consumer Law and any other applicable Warranties or Terms and Conditions provided by GS Diamonds.

3. Eligibility Requirements

3.1 To qualify as an Eligible Item for the purposes of this Guarantee, the item must satisfy all of the following requirements:

  • The purchase price of the item must be less than $15,000, inclusive of GST
  • The item must be paid in full at the time of purchase;
  • Where the item is made available for collection, it must be collected within 30 days after notification by a GS Diamonds representative that the item is ready for collection; Failure to collect the item(s) within this thirty (30) day period will result in the item(s) becoming ineligible for return under the Return Policy. 
  • The item must be in unworn, unused, and brand-new condition.
  • The item must be accompanied by all original certificates and relevant documentation.
  • The item must not be custom-made.
  • The item must not be a sale item.
  • The item must not be an Infinity Ring; and
  • The item must not have been purchased by way of a payment plan.

3.2 Any fees paid for Fast Track services are non-refundable and are excluded from any refund under this Guarantee.

3.3 This Guarantee does not apply in circumstances where the issue giving rise to the return is an incorrect ring size selection, and standard resizing or remake fees would otherwise apply.

4. Certified Gemstone Quality Requirements

4.1 Where an item contains a certified gemstone, the gemstone must meet the quality requirements set out in the GS Diamonds Diamond Inspection Policy.

4.2 Without limitation, the following quality standards apply:

  • The gemstone must not display brown, green, or milky tinges.
  • For certified round diamonds: Cut must be Excellent (EX) or Ideal; Polish must be Excellent (EX); and Symmetry must be Excellent (EX);
  • For certified fancy-shaped diamonds: Polish must be Excellent (EX) to Very Good (VG); and Symmetry must be Excellent (EX) to Very Good (VG).

5. Claim Procedure

5.1 To make a valid claim under this Guarantee, you must notify GS Diamonds by phone or email within 30 days from the date of collection or delivery of the Eligible Item.

5.2 Your notification must include a clear and legible copy or photograph of the proof of purchase for the Eligible Item.

5.3 You must provide any additional information reasonably requested by GS Diamonds for the purpose of assessing the claim.

5.4 You must return the Eligible Item together with all packaging, parts, accessories, certificates and documentation relevant to the purchase.

5.5 Claims will be reviewed by the GS Diamonds Quality Control department. Assessment of a claim may take approximately 7 to 10 business days, following which GS Diamonds will notify you of the outcome.

5.6 You are solely responsible for all costs associated with returning an item to GS Diamonds for assessment or processing under this Guarantee.

6. Condition Assessment and Validation

6.1 GS Diamonds reserves the right to inspect, validate and assess the condition and authenticity of any item returned, and to request any information reasonably required for that purpose.

6.2 For a claim to be approved, the Eligible Item must be returned in brand-new condition, without wear, use, damage, alteration, or missing documentation, as reasonably determined by GS Diamonds.

6.3 GS Diamonds reserves the right to reject any claim that it is reasonably considered to be fraudulent, misleading, incomplete, or otherwise non-compliant with this Guarantee.

7. Fair Use Policy

7.1 This Guarantee is intended to apply only to genuine retail purchases and is subject to fair use.

7.2 A maximum of one claim per customer per calendar year may be made under this Guarantee.

7.3 Without limiting clause 7.1, GS Diamonds may reject a claim where it reasonably considers that:

  • The annual claim limit has been exceeded.
  • Multiple similar items were purchased for comparison purposes with the intention of returning one or more of them.
  • The transaction or claim forms part of behaviour that is abusive, excessive, or inconsistent with the intended purpose of this Guarantee; or
  • The claim is fraudulent or otherwise not genuine.

7.4 Nothing in this clause 7 limits any rights you may have under the Australian Consumer Law.

8. Refund Process

8.1 Where a claim is approved, GS Diamonds will arrange payment of the refund by electronic funds transfer (EFT). Refunds are processed via the original payment method and can take up to 2 weeks.

8.2 You are responsible for ensuring that the bank account details and account name provided for the refund are accurate and complete.

8.3 GS Diamonds is not responsible for payments made to incorrectly nominated bank accounts, or for any delay, rejection, fee, or other issue caused by your financial institution or the information provided by you.

8.4 Approved refunds will generally be processed within 5 business days after the claim has been approved.

9. Variation, Withdrawal and Survival

9.1 GS Diamonds may amend, suspend or withdraw this Guarantee at any time without notice.

9.2 Any valid claim submitted before any amendment, suspension or withdrawal takes effect will be assessed in accordance with the version of the Guarantee that applied at the time the claim was submitted.

10. General Provisions

10.1 This Guarantee is valid and enforceable only in Australia.

10.2 The benefit of this Guarantee is personal to the original purchaser and may not be assigned, transferred, relied upon, or enforced by any other person.

10.3 Severance: If any provision (or part of it) under this Guarantee is held to be unenforceable or invalid in any jurisdiction, then it will be interpreted as narrowly as necessary to allow it to be enforceable or valid. If a provision (or part of it) under this Guarantee cannot be interpreted as narrowly as necessary to allow it to be enforceable or valid, then the provision (or part of it) must be severed from this Guarantee and the remaining provisions (and remaining part of the provision) of this Guarantee are valid and enforceable.
