Overview

This website is operated by Enjoy The Wood Inc. Throughout the site, the terms “Enjoy The Wood”, “we”, “us” and “our” refer to Enjoy The Wood Inc. Enjoy The Wood offers this website, including all information, tools, services, and items for purchase available from this site to you (“Service(s)”), the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our Service and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new features or tools that are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. You can view Shopify’s terms HERE.

1. Online Store Terms

You represent and warrant that you are of legal age to form a binding contract.

You will only use the Services for your own internal, personal, use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Terms is prohibited by applicable laws, then you aren’t authorized to use the Services. We won’t be responsible for your using the Services in a way that breaks the law.

You may choose to sign up for an account if we have enabled that function, and select a password and username. If you sign up for an account, you promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your Enjoy The Wood User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account or password to anyone else without our prior written permission. 

You’re responsible for any activity associated with your account.  Enjoy The Wood is not liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

2. Trademarks

Enjoy The Wood’s name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pattern or its affiliates or licensors. You must not use such marks without the prior written permission of Enjoy The Wood. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

3. Original products

All rights to original wall decor are reserved by the author – Ihor Fostenko. As a result of human creativity and innovation, our designs, goods, and innovations are confirmed by the patents of the Ukrainian Institute of Intellectual Property. Industrial design patent No. 36373 “Wall decoration “Wooden map of the world” (February 26, 2018); Industrial design patent No. 39373 “Wall decoration “World Map” (May 27, 2019); Industrial design patent No. 39374 “Wall decoration “World Map” (05.27.2019); Industrial design patent No. 39695 “Wall decoration “Map of the world” with illumination (07/10/2019). International patents: No. D/200510 (27.02.2019) and No. DM/203 012 (12.06.2019).

4. Product Information

All goods available on the Site are subject to change without notice and are not available while production lasts. You should regularly consult the Site for updates regarding product availability.

Although Enjoy The Wood has made reasonable efforts to display and describe our products and their colors and textures accurately, the displayed colors and textures of the products depend upon several factors including the user’s monitor, and we cannot guarantee that the user's monitor or other factors will result in the accurate portrayal of the actual colors or textures of the products.

The products are not geographical ones, just a decor that's why some smaller objects (countries or islands) may be omitted. Each product is unique and shades vary because it's made of natural materials. 

Some items on the Site may be mispriced, or described inaccurately, and Enjoy The Wood may experience delays in updating information on the Site and in our advertising on other sites. 

Products displayed may not be available yet, maybe out-of-stock, or discontinued, and prices are subject to change without prior notice. Prices for the same product may vary between enjoythewood.com and other stores. 

Enjoy The Wood is not responsible for typographical errors regarding price, measurements, or any other matter. As a result, Enjoy The Wood cannot and does not guarantee the accuracy or completeness of any information, including prices, product images, specifications, and availability. Enjoy The Wood reserves the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

5. Prices and Payments

Prices are subject to change without prior notice, except that once an order is complete, pricing will not be adjusted.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

Occasionally we will offer special discounts or other offers to our customers. These offers may be for a limited time and for limited products and Services only, and by taking advantage of any such offer, you are agreeing to any discount terms communicated to you through the Services.

Payment Method The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If your Payment Method is not authorized or accepted, Enjoy The Wood reserves the right to cancel your order without notice and with no further liability or obligation to you.  Enjoy The Wood reserves the right to stop accepting credit cards from one or more issuers at any time and for any reason.

Tax charges are based on applicable federal, state, provincial, and harmonized sales tax rates based on the delivery address associated with your order. Enjoy The Wood are responsible for any customs and import taxes that may apply. We are not responsible for delays due to customs.

6. Orders Preparation

The time we need to prepare an order for shipping (delivery) is 1-4 business days (for the USA) and 3-5 business days (for Europe and the rest of the world). But usually, we are doing everything possible to send your order ASAP. Please NOTICE that we prepare and ship orders on BUSINESS days from Monday to Friday which does not include weekends. Saturday and Sunday are not counted as part of shipping days. Also, we want you to know that sending, preparing, and shipping (delivery) are 2 different processes. And each has its own term.

7. Limits on Purchases

We do not authorize the purchase of our merchandise for resale purposes. To enforce this or any other policy, we may, in our sole discretion, limit or cancel quantities purchased, including without limitation, per person, per household, per account, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. We also reserve the right to cease doing business with those customers violating this policy. We may modify this policy at any time without prior notice.

8. Consent to receive periodic messages

As part of the Services, you may receive communications through the Services, including messages that Enjoy The Wood sends you (for example, via SMS or email). When purchasing a product on the Site, you will be opted in to receive our marketing emails, which will include instructions on how to stop receiving messages. BY USING THE SERVICES, YOU AGREE TO RECEIVE COMMUNICATIONS FROM ENJOY THE WOOD. You agree to indemnify and hold Enjoy The Wood harmless from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys’ fees) arising from or in any way related to your breach of the foregoing.

9.  Mobile Message Service Terms and Conditions

Your use of the Mobile Service constitutes your agreement to these terms and conditions (“Mobile Terms”) and Enjoy The Wood’s overall Terms of Service, and your acknowledgment that you have read and understand Enjoy The Wood’s Privacy Policy, as amended from time to time (together, “Terms”). Before using the Mobile Service, please read these Terms carefully. We may modify or cancel the Mobile Service or any of its features without notice. We may also modify these Mobile Terms at any time, and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.

When you provide us with your mobile phone number and agree to receive text messages from us, you are expressly agreeing that Enjoy The Wood may send you text messages (including SMS and MMS) to that phone number, including through the use of automated or autodialer technology. You represent that you are of legal age to form a binding contract and are the owner or authorized user of the wireless device on which the text messages will be received. Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive auto-marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Mobile Service will provide text messages for purposes that will be further detailed in our request for your consent, but may generally include updates, alerts, information, promotions, specials, and other marketing offers from Enjoy The Wood via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Message and data rates may apply to each text message sent or received in connection with the Mobile Services, in addition to any applicable roaming charges.

10. Use of the Site

The materials displayed or performed or available on or through the Services, including, but not limited to, text, graphics, data, articles, photos, products, images, illustrations, digitally downloadable files, trademarks, logos, trade dress, packaging, product and program names, slogans, any other content and the compilation of the foregoing (all of the foregoing, the “Content”) and User Submissions are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content and/or User Submission you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, commercialize or otherwise exploit for any purpose any User Submission not owned by you or any Content, without the prior consent of the owner of such content.

11. User Submissions

  • you will not use any electronic communication feature of the Site for any purpose that is unlawful, tortious, abusive, intrusive on another’s privacy, harassing, libelous, defamatory, embarrassing, obscene, threatening, hateful, invasive of the privacy of another person, abusive, racist, infringing, pornographic, violent or otherwise objectionable or inappropriate as determined by Enjoy The Wood;
  • you will not upload, post, reproduce, or distribute any information, software, or other material protected by copyright or any other intellectual property right (as well as rights of publicity and privacy) without first obtaining the permission of the owner of such rights;
  • you will not collect, store, or post any content that contains personal information about other users or any individual, violates the privacy/publicity of any other individual or entity, or anything that you are under a contractual obligation to keep private or confidential; 
  • you will not use the Site for any commercial purpose not expressly approved by Enjoy The Wood in writing;
  • you will not upload, post, email, or otherwise transmit any advertising or promotional materials or any other form of solicitation or unauthorized communication;
  • you will not impersonate any person or organization, including without limitation, the personnel of Enjoy The Wood, or misrepresent an affiliation with another person or organization;
  • you will not upload, post, email, or otherwise transmit any material that contains viruses or any other computer code, files, or programs which might interrupt, limit, or interfere with the functionality of the Site, any computer software or hardware, or telecommunications equipment.

12. User Comments, Feedback, and Other Submissions

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. 

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. 

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

13. The additional restrictions for using Terms of Service

You represent, warrant, and agree that you will not submit any Content or User Submission (each of those terms is defined below) or otherwise use the Services or interact with the Services in a manner that:

  • Infringes or violates the intellectual property rights, right of publicity or privacy, or any other rights of anyone else (or Enjoy The Wood);
  • Violates any law or regulation, including, without limitation, any applicable export control laws;
  • Is tortious, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
  • Jeopardizes the security of your Enjoy The Wood account or anyone else’s (such as allowing someone else to log in to the Services as you);
  • Attempts, in any manner, to obtain the password, account, or other security information from any other user;
  • Violates the security of any computer network, or cracks any passwords or security encryption codes, or that contains viruses or any other computer code, files, or programs which might interrupt or limit the Services;
  • Collects, stores, or posts personal information about other users or any other individual;
  • Is for advertising or promotional materials or any other form of solicitation or unauthorized communication.

A violation of any of the foregoing is grounds for termination of your use or access to the Services.

14. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy. Our Privacy Policy is incorporated by reference into these Terms of Services, and your agreement to be bound by these Terms of Services means you are also bound by the Privacy Policy.

15. How to stop using the Services 

You’re free to stop using the Services at any time. To delete your account at any time, please contact us at service@enjoythewood.com. Account termination may destroy any User Submissions associated with your account, so keep that in mind before you decide to terminate your account.

Enjoy The Wood is also free to terminate (or suspend access to) your use of the Services, the Site, or your account, for any reason at our discretion, including your breach of these Terms.  Enjoy The Wood has the sole right to decide whether you violate any of the restrictions outlined in these Terms.
