That is why I write with tough love rather than false assurances. Stop waiting for America to return. Stop believing these policies are temporary. Hope is not a strategy. There will be no building back this time; rather, it will be building something new. In the best case scenario, a stronger Europe will be waiting for us when that work begins. ❤️

Bijan Sabet liked thisBijan Sabet liked thisSo, about last week… What a privilege to join Executive Directors of Fulbright Commissions from around the world in Washington, D.C., reconnect with alumni of the Czech Fulbright Program, and celebrate 80 years of Fulbright! Representing Fulbright Commission Czech Republic at this milestone was particularly special. I've been with the program for just over a year, but I've already seen firsthand what Fulbright makes possible. Students and scholars return with new perspectives, friendships and professional connections are formed that often last a lifetime, and Czechs and Americans work together to push the boundaries of knowledge, research, and innovation. And when you hear Fulbrighters describe their experience as "the best time of my life," you realize that the impact goes far beyond academic and professional achievements. Sometimes, that impact shows up in rather unexpected places. During our visit to the National Archives, we learned that the Declaration of Independence and the U.S. Constitution rest on what is known as "Fulbright paper" - preservation paper developed by Fulbright Scholar Timothy Barrett from the University of Iowa, whose research was shaped by his Fulbright experience in Japan. A fascinating story and a wonderful example of how a Fulbright experience can leave a lasting mark - quite literally - on history. Here's the story: https://lnkd.in/e7Fk4G9z But perhaps what stayed with me most was being in a room with colleagues from across the globe, exchanging ideas, experiences, and the occasional challenge. Different countries, different perspectives, but a shared belief in the power of education, exchange, and human connections. It was a powerful reminder of just how global - and how deeply human - this work is. I'm grateful to my colleagues around the world, our Board, our partners, and especially the wonderful team at Fulbright Commission Czech Republic. And, above all, to the generations of Fulbrighters who give this program its meaning. Here's to the next 80 years!

Bijan Sabet liked thisBijan Sabet liked thisI was honoured to receive an award for excellence in teaching, based on student evaluations of my foreign policy courses during my first semester at IE University. I haven't taught since I was a teaching assistant during my PhD program, a distant time before laptops and AI. I taught an introductory course on the European Union. I was 22 years old, looked young enough to be mistaken for a student, and was painfully aware of how little I actually knew -- having never even visited Brussels. I promised myself that if I ever taught again, it would be from the perspective of lived experience with stories to tell. And do I have stories now. I've loved my time in the classroom. I'm grateful to my students, coming from every corner of the world, who challenge my thinking, offer new insights, and give me hope about the future leadership of an increasingly complicated world.

Bijan Sabet liked thisBijan Sabet liked thisThis evening, my amazing wife Katarína was awarded the Medal of Merit by the President of the Czech Republic. And … 🥹… 🥹…, watching her up there, I don’t think I’ve ever been more moved. These Medals are a big deal here - granted to only a few dozen people a year, at a high-profile state ceremony at the Prague castle. The event, taking place on Czech Independence Day, airs on major TV stations and is watched by 20%+ of the entire population of the country 🤯. But the coverage isn’t the point of course. The point is why she got the Medal: her relentless work in palliative care. As chief physician of a Prague’s leading hospice organization, Katarina is one of the people quietly changing how this country cares for those at the end of life. That’s a lot of hard, tender, often invisible work - and I know she pours everything into it. Congratulations, my dear. So so very proud of you! ❤️ Oh – and by the way, I happened to receive one of the Medals too! Which, I suppose, officially makes us a power couple 😅. Fun fact: a couple both receiving this honor has happened only once in the entire history of the country. It didn’t age well though - four years later they were both convicted of a violent crime. So consider this our public pledge to behave 🤣.

Governments are often positioned as defendants, responding to claims, managing liabilities, and absorbing losses. But there is another path. Join us tomorrow at the ICGFM Conference with Laura Robinson, Tatiana Sainati and Jamie Head reframing public assets and examining how grand corruption civil claims and investment contract claims can represent a significant, yet largely untapped, source of value and resource for sovereigns. When properly structured, these claims are not just legal tools, they are recoverable assets. They can restore public funds, strengthen governance, and shift the balance of power. Instead of reacting, governments can take the lead, asserting their rights, pursuing accountability, and driving outcomes aligned with national priorities. We look forward to continuing this conversation. #AssetRecovery #PublicAssets #Governance #AntiCorruption #DevelopmentFinance

It was a pleasure to participate in last week's panel at Trellis discussing the critical role of due diligence in carbon project investments. We had a lively discussion about how legal diligence—along with financial and technical diligence— identifies risks and also creates value in a project and supports market integrity. Legal diligence is especially important now with evolving host country legal frameworks that must be navigated along with Article 6 requirements and other programs like CORSIA. Thank you to Trellis, my fellow panelists and our moderator, Leslie, for the thoughtful discussion. Honored to be quoted by Melinda Lucy (nee Huspen) in this insightful article in American Banker discussing BitGo's recent acquisition of NYDIG's institutional trading division, which appears to be a win for both companies. Vertical integration and regulatory credentialing are becoming competitive differentiators. We should expect to see continued consolidation along these lines as the OCC charter framework takes hold and the market rewards digital-assets platforms that can offer institutional clients a cohesive, federally supervised suite of services. #fintech #digitalassets #foxrothschild

The Bankruptcy & Creditors’ Rights Practice Group at Mandelbaum Barrett PC recently secured a full recovery on behalf of an upstate New York farmer under the Perishable Agricultural Commodities Act (PACA). Led by Joshua S. Bauchner and Jed Weiss, the team recovered all sums owed—plus fees and costs—after a wholesaler filed for Chapter 11 bankruptcy. Following partial payment through the Bankruptcy Trustee, the Firm pursued the principals in the Southern District of New York for misuse of PACA trust funds, achieving complete repayment for the client. This result underscores our team’s skill in protecting creditors and enforcing payment rights under federal and bankruptcy law. 📢Update to my post below, the California regulators (DFPI) have now issued the form report by which VC fund managers must submit the demographic survey data they are required to collect from their portfolio company founders. Please find the reporting form here: https://lnkd.in/gG2qxpvk. ❓The DFPI has not yet uploaded the portal by which covered entities must initially register (deadline March 1st) and submit the newly issued report (deadline April 1st), but we here at Sidley Austin LLP will be sure to keep you updated. 💡Start planning now by reviewing the relevant definitions of the legislation to determine which of your entities must register and your relevant portfolio investments in 2025 to begin preparing survey transmission communications and keep abreast of the relevant updates from DFPI with respect to interpretive guidance, timing of the upload of the submission portal and other important information - check here: https://lnkd.in/gbTiNRjj #SidleyVC #SidleyInvestmentFunds #SidleyVenture

📢 Attention Venture Capital Fund Managers: New California Transparency & Reporting Law You Must Know - Deadlines Looming! 📊 California has ushered in a first-of-its-kind transparency regime that will meaningfully impact VC firms with a nexus to the state — no matter where you’re headquartered. Under the Fair Investment Practices by Venture Capital Companies Act, covered entities must register and report demographic data on the founding teams of companies in which they invested during 2025 - beginning this year. 🔎 Here’s what VC firms need to know (high-level): ✅ Who is covered? Any "venture capital company" that 1) primarily invests in or finances early-stage or growth companies and 2) has a CA nexus — including: • Headquarters or significant presence in CA. • Investments in CA-based companies or companies with significant operations in CA. • Solicits or accepts investment from CA residents/account holders. 📅 Key deadlines: • March 1, 2026: Register with the California Department of Financial Protection and Innovation (DFPI) as a covered entity. • April 1, 2026: First annual demographic report due, covering 2025 investments. 📊 What must be reported? • Aggregated, anonymized demographic data voluntarily provided by founders (gender identity, race/ethnicity, disability status, veteran/LGBTQ+ status, CA residency). • Numbers and dollar amounts of investments in companies primarily founded by diverse teams. • Principal place of business for companies. 📋 Covered entities must distribute the standardized DFPI survey to founding teams to collect this information and incorporate it into their annual report. ⚠️ Why this matters: This requirement extends beyond traditional Silicon Valley firms. Even funds without a physical CA office may be caught if they have a CA investor or portfolio company. Non-compliance could expose firms to enforcement actions and penalties. ⚠️ What DFPI Still Needs to Clarify or Finalize Despite the statutory framework, material implementation details are still evolving, including: • Final reporting format and submission mechanics • How DFPI will interpret “CA nexus” in edge cases • Treatment of complex fund structures, SPVs, and parallel vehicles • Data validation, audit expectations, and record-retention standards • Enforcement posture and penalty framework for non-compliance • How updates or corrections to prior-year reports will be handled In short: the obligations are real, but the operational playbook is still being built, but funds that wait until guidance is finalized may find themselves compressed on timing. 🔗 Learn more and access official DFPI resources: 👉 DFPI VCC Reporting Program: https://lnkd.in/gHRxvwHP 👉 DFPI Survey: https://lnkd.in/gV_Bh2vM 💬 Be sure to discuss how this impacts your firm’s compliance and reporting strategy with your friendly neighborhood fund counsel.
