Priests have also been accused of child sexual abuse at:
- Santa Paula
- Good Shepherd
- Corpus Christi
- Mount Carmel
- Holy Trinity
- Our Lady of the Sacred Heart
- Most Precious Blood
- Our Lady Queen of the World
- Immaculate Heart of Mary
When proven guilty, priests accused of child sexual abuse are subject to criminal charges and civil claims. California clergy sexual abuse lawyers play an important role in helping victims overcome a history of child sexual abuse in the church, providing them with resources for perpetual help. The legal system gives child victims a voice to overcome clergy abuse, and further information can be obtained through legal counsel.
Legal Support for Clergy Abuse Survivors in California
A civil suit alleges that child sexual abuse occurred and aims to seek justice through the financial recovery of damages. While receiving compensation doesn’t forgive the child sexual abuse, civil or private settlements can help victims pay for the resources they need to assist in recovery.
Credible accusations of sexual misconduct also help bring light to a bigger problem while ensuring that those with credible accusations against them can no longer hold that same power over other members. It can ensure that priests accused of child sexual abuse won’t be in a position to engage in further sexual misconduct.
What Laws Govern Priest Abuse Lawsuits in California?
California has several laws in place to help protect victims of child sexual abuse. Some acts extend the statute of limitations, giving victims plenty of time to file a suit against credibly accused priests or an associate pastor. Mandating reporting can help catch those who are sexually abusing minors, too.
Statute of Limitations
The statute of limitations is how long a person has to file a lawsuit against someone for a specific crime. Each crime has its own time limit for a lawsuit, including child sexual abuse. In California, it depends on when the child sexual abuse occurred.
If before 2024, victims of sexual abuse have until their 40th birthday or five years after they realized the child sexual abuse was connected to their injuries to file a suit against credibly accused priests.
If the alleged sexual abuse happened after 2024, there is no statute of limitations for children.
Adults have a different timeframe. Those who suffered from alleged sexual abuse have ten years after the incident or three years after they discover the injury, whichever is later.
Sexual Abuse and Cover-Up Act
California legislators made note of cover-ups for sexual misconduct and other clergy abuse to protect the credibly accused. The Sexual Abuse and Cover-Up Act (AB 2777) created a lookback window to allow victims to file a suit against credibly accused priests or other members of a religious order, such as an assistant pastor.
Claims for damages suffered on or after January 1, 2009, that would otherwise be barred by the statute of limitations or a prior statute of limitations may be revived. However, the lookback window closes on December 31, 2026, making it essential to explore filing a suit against the credibly accused priest or clergy member now.
