Gowree Gokhale shared thisBeing a director, promoter of speciality chemical company, I echo the sentiment in this article that the sector has tremendous growth potential. However, 'ease of doing business' should substantially improve both at the Central and State level. e.g. even simple name change approval in relevant licenses takes forever.. why can't MCA change automatically reflect across all licenses ? This is just one example. Request industry associations to get into these practical issues and help the industry and government to achieve ease of operations. If these issues are not resolved, the acceleration that is required will not be achieved. The 2047 vision will only remain on paper. Today, I read another article on how passport office is very efficient, with cordial staff, corruption less etc. That is a great example of achieving efficiency. #FICCI Ameya Jogalekar Arun Jogalekar https://lnkd.in/dtpFXXq9Chemicals, petrochemicals sector can become key growth engine of Indian economy: MoS Anupriya Patel at launch of 'India Chem 2026'Chemicals, petrochemicals sector can become key growth engine of Indian economy: MoS Anupriya Patel at launch of 'India Chem 2026'

Gowree Gokhale posted thisIt has been a very enriching experience conducting workshops with various industries and stakeholders on the DPDP Act and its implementation across India. One of the key issues that has emerged is compliance by NGOs and organisations processing the data of Data Principals who are not connected to the internet. How does one obtain and record consent, particularly where data is collected on a large scale at a physical gathering and later digitised? Where children’s data is collected in orphanages, how is consent to be managed? How do Data Principals who are not digitally connected exercise their rights? Are donors also Data Fiduciaries, requiring them to create mechanisms for exercise of rights? There are several such practical issues relating to consent, parental consent, notices and exercise of rights in an offline environment. MeitY should consider an appropriate exemption or mechanism to address such situations. I would be interested in hearing from NGOs and others in similar situation about additional issues. Please DM me. Inviting attention of tech platforms creating DPDP Act solutions to that points so that technological solutions may emerge to manage them. I may take up some other issues in separate, topic wise posts.

Through real-world workplace situations brought to life on stage, the performance invites us to look beyond policies and procedures to examine the human behaviours, decisions and organisational cultures that shape compliance. In a recent judgment in Gloster Limited v. Gloster Cables Limited, the Supreme Court has held that the NCLT, while exercising powers under Section 60(5)(c) of the Insolvency and Bankruptcy Code, cannot declare or adjudicate disputed trademark title merely because the controversy surfaces in the course of a corporate insolvency resolution process. The Court found that the Kolkata Bench of the NCLT exceeded its jurisdiction when it effectively vested ownership of the “Gloster” trademark in the successful resolution applicant, even though the dispute was a long‑standing IP ownership battle between two independent entities.

Indian Supreme Court’s ruling allowing modification of arbitral awards has created uncertainty among arbitration practitioners outside India over how and when courts may alter awards, Vice President of the ICC International Court of Arbitration VK Rajah said on Sep 04. India has made strong progress since BALCO, but Rajah said recent developments on modifying awards have made outcomes harder to predict. Rajah was speaking at Gujarat High Court Arbitration Centre's Arbitration Week 2026 at GIFT City Club, Gandhinagar. ⚖️ Supreme Court Clarifies Rights of Partners After Dissolution of a Partnership Firm A significant judgment for partnership disputes has been delivered by the Supreme Court in: V. Sumitra Reddy & Anr. v. K. Ranganadha Reddy & Ors. 2026 INSC 979 Decided: 9 September 2026 The case concerned the rights of a partner in the assets of a dissolved partnership firm and the application of Sections 46 and 48 of the Indian Partnership Act, 1932. Key takeaways: 1. Dissolution triggers settlement of the firm’s affairs After dissolution, the firm’s assets and liabilities have to be dealt with before the partners’ final shares can be determined. 2. Section 48 provides the mechanism The statutory sequence includes payment of third-party debts, settlement of advances and capital, followed by distribution of the residue among partners according to their rights. 3. Liquidation can become necessary Where partners do not mutually agree upon settlement, the firm’s assets may have to be realised and the proceeds distributed according to the partners’ respective shares. 4. A dissolved firm’s assets cannot simply be treated as assets of a reconstituted firm The judgment addresses the rights of partners of the dissolved firm where the remaining partners continue business through a reconstituted firm. 5. Retirement and dissolution are legally distinct The Supreme Court considered the distinction between retirement—where the reconstituted firm continues—and dissolution, where settlement has to follow the statutory mechanism under Section 48. Why it matters The ruling is especially relevant to: • Family partnership disputes • Partnership firms holding immovable property • Dissolution suits • Rendition of accounts • Final decree proceedings • Valuation disputes • Claims of outgoing partners The larger lesson: dissolution of a partnership is not merely the end of the business relationship. It requires proper settlement of the firm’s assets, liabilities and the partners’ ultimate entitlements. India's latest data protection law has drawn mixed reactions from legal experts and policy researchers, with some arguing the framework bolsters privacy and individual rights, while others believe high compliance costs and ambiguity over state's use of data could weaken the legislation's original intent. Our Partner – (Co-Head – Digital | TMT) Arun Sadhanand Prabhu shares his views on this in an article published by The Economic Times. Standard template for an application for condonation of delay. This draft is specifically tailored for a Section 138 (Cheque Bounce) complaint to align with the Supreme Court's procedural requirements in S. Nagesh v. Shobha S. Aradhya. BEFORE THE COURT OF THE LD. JUDICIAL MAGISTRATE FIRST CLASS AT [CITY NAME] P.C.R. No. ______ of 2026 In the matter of: [Your Name/Complainant's Name] ... Complainant Versus [Accused Name] ... Accused/Respondent APPLICATION FOR CONDONATION OF DELAY UNDER THE PROVISO TO SECTION 142(b) OF THE NEGOTIABLE INSTRUMENTS ACT, 1881 MOST RESPECTFULLY SHOWETH: That the Complainant has filed the accompanying complaint under Section 138 of the Negotiable Instruments Act against the Accused for the dishonor of Cheque No. [Number] dated [Date] for an amount of ₹[Amount]. That as per the statutory requirements, the cause of action to file the present complaint arose on [Date]. The limitation period of 30 days expired on [Date]. That the present complaint is being filed on [Current Date], resulting in a delay of [Number of Days] days. That the Complainant was unable to file the complaint within the prescribed period due to the following sufficient cause: [Example: That the Complainant was suffering from severe viral fever/medical emergency from (Date) to (Date) and was advised bed rest. Medical certificate is attached as Annexure-A.] [Example: That the Complainant was out of station for an unavoidable family emergency and could not coordinate with the counsel in time.] That the delay is neither intentional nor deliberate, but due to the circumstances mentioned above which were beyond the control of the Complainant. That no prejudice will be caused to the Accused if the delay is condoned, as the matter involves a substantial legal debt. However, the Complainant will suffer irreparable loss if the complaint is dismissed on technical grounds of limitation. That this Hon’ble Court has the power under the Proviso to Section 142(1)(b) of the NI Act to condone the delay if sufficient cause is shown. PRAYER In view of the facts mentioned above, it is most respectfully prayed that this Hon’ble Court may be pleased to: a) Condon the delay of [Number] days in filing the accompanying complaint; b) Proceed to take cognizance of the offence after condoning the said delay; c) Pass any other order(s) as this Hon'ble Court may deem fit in the interest of justice. Place: [City] Date: [Date] [Signature] Complainant Through Counsel *Important Notes for Implementation:* The Affidavit: This application must be accompanied by an "Affidavit in Support," where the complainant swears on oath that the reasons for the delay are true. Medical/Evidence: If you cite illness, always attach a doctor’s prescription or a medical certificate. Courts are much more likely to condone delay when physical evidence is provided. #DigitalLawLearners

Courts walk a tightrope when addressing Section 11 applications, balancing the need for swift arbitration with the duty to screen out manifestly dead or time-barred claims. As jurisprudence evolves, a careful prima facie review remains essential to protect both efficiency and fairness in India’s arbitration framework. #ArbitrationLaw #LimitationAct #DisputeResolution #ADR
