  • After trying to have a child for over a decade, this couple was denied IVF treatment because the husband was 57. But the Calcutta High Court stepped in with a significant observation. The court ruled that a woman who is medically fit and legally eligible for IVF under the Assisted Reproductive Technology (ART) Act, 2021, cannot be denied treatment simply because her husband has crossed the prescribed age limit. The couple, married since 2014, had sought to conceive using sperm and ovum from an ART bank after a clinic refused treatment solely due to the husband's age. Justice Krishna Rao observed that the wife should not suffer because of her husband's ineligibility, noting that in the ART procedure, she is the gestational carrier while the husband has no physical participation beyond being a supportive partner.
