This privacy policy (“Privacy Policy”) describes how and why Innovative Language Learning USA, LLC and its subsidiaries and affiliated companies/brands (collectively, “Company,” “we,” “us,” or “our”) collects, uses, stores, discloses, and otherwise processes your personally identifiable information (“Personal Information”) when you use our services, including when you visit innovativelanguage.com and related sites (collectively, the “Website”), when you use our mobile applications (the “Apps”) or interact with us in other ways (collectively, the “Services”). It also describes the choices available to you regarding our processing of your Personal Information and how you may access, correct, or update it. The use of information collected through our Website shall be limited to the purposes under this Privacy Policy and our Terms of Use (collectively, the “Terms”). This Privacy Policy does not apply to the practices of companies or websites that we do not own or control.

BY USING THE SERVICES, YOU AGREE YOU (1) HAVE READ OUR TERMS IN THEIR ENTIRETY; AND (2) UNDERSTAND AND ACCEPT OUR TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS, PLEASE DO NOT USE THE SERVICES.

WHAT INFORMATION DO WE COLLECT?

We may collect Personal Information directly from you, from third parties, and automatically through your use of our Services. We may combine information collected from or about you from these various sources. We use this information to operate and improve our Services and Website, communicate with you, personalize your experience, conduct marketing and promotional activities, and respond to inquiries.

Personal Information you disclose to us.
The Personal Information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products or features you use. We receive and store any information you knowingly provide to us when you create an account, make a purchase, subscribe to our communications, or fill out any online forms. The Personal Information we collect may include the following:

  • name;
  • email address;
  • phone number;
  • payment data;
  • country;
  • postal code;
  • products purchased; and
  • any other information you voluntarily provide about yourself, including your age, hobbies, and interests in learning languages.

We also reserve the right to record, read, copy, disclose, and use (but not transmit to any third party) any text, speech, data, images, and other materials you transmit to us via non-public means for improving our Services.

Non-Personally Identifying Information automatically collected.
When you visit, use, or navigate the Services, we may automatically collect certain information such as device and usage information, IP address, browser and device characteristics and history, operating system, language preferences, referring URLs, device name, date and time stamps, and general location inferred from your IP address. In addition, we may collect information about user activities within our Services, such as a user’s learning progress, lessons accessed and completed, and download history.

Advertising and Third-Party Collection. On our Website and within our Services (including through ads, embedded content, and third-party tags we implement), advertising partners and analytics providers may collect Personal Information directly from your browser or device via cookies, pixels, SDKs, and similar technologies for ad delivery, measurement, and analytics. Separately, when you visit third-party websites or apps, those parties may collect information under their own privacy policies.

COOKIES

We use cookies and similar technologies to help personalize your experience, analyze usage, and improve our Services. Cookies are small text files placed on your device by a web server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie. We use both first-party cookies (set by us) and third-party cookies (set by our partners and service providers). Cookies can take the form of session cookies or persistent cookies. Session cookies expire when you close your browser and are used to make it easier for you to navigate our Website. A persistent cookie remains on your hard drive for a specified period of time. At any time, you may delete or decline certain cookies by changing your browser settings, however, some portions of our Services may not function properly.

Cookies We Use:

  • Strictly Necessary Cookies: These cookies are essential for the Website to function and cannot be disabled. They enable core functionality such as security, bot detection, and spam prevention.
  • Performance Cookies: These cookies help us understand how visitors interact with the Website by collecting information about traffic sources, user sessions, and browsing behavior. We use this data to analyze Website usage and improve performance.
  • Functionality Cookies: These cookies enable enhanced functionality and personalization, such as maintaining session consistency and remembering your preferences across visits.
  • Targeting Cookies: These cookies are used by us and our advertising partners to build a profile of your interests, deliver relevant advertisements, and measure the effectiveness of advertising campaigns.

We do not control third parties’ collection or use of your information for interest-based advertising, but these parties may offer ways to opt out. In addition to browser and cookie-banner controls, you can use the opt-out mechanisms offered by our advertising partners, such as the Digital Advertising Alliance’s opt-out page or the Network Advertising Initiative’s opt-out page.

Do Not Track Signals. Some browsers incorporate a Do Not Track feature that signals to websites you visit that you do not want to have your online activity tracked. Our Services do not respond to Do Not Track signals at this time.

ACCOUNTS

When you create an account with us, a verification email will be sent to the email address you used for registration to prove that you are the owner of the email address. When you register for a user account on our Website, you are automatically enrolled into our communication, promotional and other newsletters. You may opt out of any or all of such newsletters at any time by changing your preferences online in the Email Notifications & Banners section of the My Account page, through the unsubscribe link included at the bottom of every email newsletter, or by contacting us at contactus@innovativelanguage.com. Our email newsletters contain tracking pixels to enable log file recording and analysis to help us track the success and failure of our marketing campaigns. Based on the tracking pixel, we may see if and when an email was opened by you and which links in the emails were clicked. We use the data collected to optimize the design and delivery of our newsletters to better serve our users. We may use third-party marketing software (including Campaigner) to facilitate our marketing communications and to further assist us in the analysis and optimization of our marketing efforts.

You can also create an account with us by logging in through certain third-party accounts, such as Facebook. By logging in through a third-party account, you grant us permission to access certain information from that third-party account, as explained on the permissions page when you log in.

HOW DO WE PROCESS YOUR INFORMATION?

We process your Personal Information for a variety of reasons, depending on how you interact with our Services, including:

  • to deliver and facilitate delivery of the Services, provide customer service, and operate the Website;
  • to respond to user inquiries and provide support, including order confirmations and communications about your purchases or requests;
  • to send administrative information, such as updates about our products and Services, changes to our Terms, and other transactional or service-related notices;
  • to request feedback about your use of the Services;
  • to debug and identify and repair errors that impair existing functionality of our Services;
  • to manage our business operations;
  • to send you marketing, promotional, and notification communications consistent with your preferences, including newsletters that may include tracking pixels to help us analyze and improve our communications;
  • to send notification emails such as password reminders or updates;
  • to deliver targeted advertising and personalized content tailored to your interests and location;
  • to evaluate and improve our Services, products, marketing, and your experience, including identifying usage trends, measuring campaign effectiveness, and optimizing our Website and offerings;
  • to send marketing and promotional communications personalized to your booking or transaction activity when you complete a transaction with one of our affiliate partners;
  • to comply with our legal obligations and exercise our legal rights, including responding to lawful requests and protecting against fraud, abuse, and unauthorized transactions; and
  • to fulfill other purposes disclosed to you at the time of collection or otherwise compatible with the context of collection.

Sensitive Personal Information.
We do not process, collect, sell, or share sensitive personal information such as Social Security numbers, racial or ethnic origin, political opinions, religious beliefs, health data, or criminal history (“Sensitive PI”). We also do not use or disclose Sensitive PI for purposes that would require offering the right to limit under California law. If this changes, we will provide separate notices and, where required, offer the right to limit use and disclosure. Please do not submit any Sensitive PI to us.

Profiling and Automated Decision-Making.
We do not use automated decision-making that produces legal or similarly significant effects without human involvement. Where we use profiling for targeted advertising or marketing optimization, you may opt out as described in the “What Are Your Privacy Rights?” and “Your State Privacy Rights” sections below.

WHEN AND WITH WHOM DO WE SHARE YOUR INFORMATION?

We may share your Personal Information with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work.

We do not sell or disclose any Personal Information about you to any third party except to provide you with products or services you have requested, where we have your consent, or under the circumstances listed below:

  • With other users of our Services in order to provide our Services (but not your email address or password);
  • To our teachers in order to provide Services you have requested;
  • To nonaffiliated companies that we engage as contractors or agents to perform services for us, such as administering our Website, systems, and software; sending direct mail communications; or administering events, in which case we will disclose your information with such contractors only to the extent reasonably necessary for them to perform services on our behalf, consistent with this Privacy Policy;
  • In response to subpoenas, court orders, or legal process, from law enforcement agencies or state and federal regulators, or as otherwise required by law;
  • To assert or defend our legal rights, including fraud prevention and enforcing this Privacy Policy and our Terms of Use;
  • To protect the rights, property, or safety of us or other persons, including to detect, prevent, or otherwise address fraud, security, or technical issues, or anything else that we may consider to be, or pose a risk of being, an illegal, unethical, or legally actionable activity;
  • As we deem appropriate to attempt to prevent physical or emotional harm to other persons and/or to their property based on overt or implied threat; and
  • In connection with an actual or proposed corporate merger, acquisition, asset purchase, or other transaction or proceeding involving all or part of the business or assets to which the information pertains.

We may also disclose aggregate, anonymized, or de-identified information about users for marketing, advertising, research, compliance, or other purposes.

Sale/Share/Targeted Advertising Disclosures. We do not sell Personal Information for money. We may “sell” or “share” Personal Information as those terms are defined by certain U.S. state privacy laws by allowing advertising, social media, and analytics partners to collect Personal Information via cookies, pixels, software development kits (SDKs), or similar technologies in our Services for cross-context behavioral advertising and measurement. You may opt out of such “sale,” “sharing,” and “targeted advertising” at any time as described in the “What Are Your Privacy Rights?” and “Your State Privacy Rights” sections below or via the “Do not sell or share my personal information” link located in the footer of the Website.

THIRD PARTY WEBSITES

THE WEBSITE AND/OR SERVICES MAY CONTAIN LINKS TO THIRD-PARTY OWNED AND/OR OPERATED WEBSITES. WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF ANY THIRD-PARTY WEBSITE. We suggest that you contact these third parties directly for information regarding their privacy, security, and data collection and distribution policies prior to providing them with any information. We are not responsible for managing third-party communications; if you no longer wish to receive communications from a third party, please contact that third party directly.

Third-Party Service Providers. We use third-party service providers who may collect Personal Information in connection with the Website, including:

  • Payment Processors: We do not store or process your credit card number on our servers, we use payment processors, including PayPal and Authorize.Net (Visa). For more information on their privacy practices, please see PayPal’s Privacy Statement and Visa’s Privacy Notice.
  • Business Optimization: Including Google Analytics, Google AdWords, and Google Tag Manager to assist us in analyzing usage information. To learn more about Google’s privacy practices, visit their privacy center.
  • Marketing Software: Including Campaigner to send out email communications and promotional newsletters. To learn more, please view Campaigner’s Privacy Policy
  • Microsoft Bing AdWords: We use Microsoft Bing Ads to deliver and measure advertising. To learn more, please view Microsoft’s privacy policy.
  • Meta: We use Meta technologies to deliver and measure advertising. To learn more about Meta’s data practices, please view Meta’s privacy policy.

This list is illustrative and may change over time. Additional third-party providers support functionality, analytics, performance, security, advertising, and email services in connection with the Website. Any information obtained by such third parties from our users or us is and will remain our property, and will be subject to this Privacy Policy. Where required by law, we maintain data processing agreements with our service providers and contractors to help protect Personal Information they handle on our behalf.

Affiliates. We may disclose Personal Information about you to our affiliates for the purpose of being able to offer you related or additional products and services. Any information relating to you that we provide to our affiliates will be treated by those affiliates in accordance with our Terms.

HOW LONG DO WE KEEP YOUR INFORMATION?

When we no longer have a legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), we will securely store your Personal Information and isolate it from any further processing until deletion is possible. We retain Personal Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including to satisfy legal, accounting, or reporting requirements, and then delete or de-identify it consistent with applicable law.

HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical, organizational, and administrative safeguards designed to protect the security, confidentiality, and integrity of Personal Information we process. These measures include, among other things, access controls, least-privilege practices, logging and monitoring, vulnerability management, and encryption in transit (TLS/SSL). The Website uses a valid server certificate to help protect session integrity.

We also require our service providers and contractors that handle Personal Information on our behalf to maintain appropriate security measures and confidentiality commitments consistent with applicable law and industry standards.

Despite our safeguards and efforts to secure your information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your information. Transmission of Personal Information to and from our Services is at your own risk. If we become aware of a data breach affecting Personal Information, we will investigate and provide notifications to individuals and/or regulators as required by applicable law.

As a service to our users, we feature blogs, lesson comments, and forum posts for users to interact with each other and with us. We may retain this information as necessary to resolve disputes, provide customer support, and troubleshoot problems as permitted by law. Information shared in blogs, lesson comments, and through forum posts is accessible to the general public and may be viewed, disclosed to, or collected by third parties that do not adhere to our Terms or that may use the information to send you unsolicited communications. Content you post publicly may also be indexed by search engines, cached, archived, or redistributed by others and may persist even after deletion from the Services. We encourage you to think carefully before disclosing any Personal Information in any public forum.

Data Breach. You should take steps to protect against unauthorized access to your password, phone, and computer including, but not limited to, signing off after using a shared computer; choosing a strong password that cannot be easily guessed, and keeping your login name and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

If we determine or reasonably suspect a security incident affecting the Website or Services, including unauthorized access, acquisition, or disclosure of Personal Information, we will investigate, contain, remediate, and where appropriate or required by law, report the incident and notify affected individuals and applicable authorities without undue delay. We will cooperate with law enforcement and may provide notice by email and/or on the Website, as permitted by law.

DO WE COLLECT INFORMATION FROM MINORS?

The Website and the Services are intended for a general audience and are not directed to users under 16. By using the Services, you represent and warrant that you are at least 16 years old. We do not knowingly collect Personal Information from minors under 16, and users under 16 must not use the Services. If we learn that a child under 16 has provided Personal Information, we will delete it or take steps to de-identify it promptly as required by law. If you believe we may have collected Personal Information about a child under 16, please contact us at contactus@innovativelanguage.com with “Minor Data Collected Notification” in the subject line.

YOUR USE OF OTHER MEMBERS’ INFORMATION

Through regular use of our Website, as a member you may have access to another member’s contact or Personal Information. By registering for our Website and accepting our Terms, you agree that you shall not disclose another member’s Personal Information to any third party for any reason unless: (1) our Terms permit disclosure; (2) you have obtained consent from the other member; (3) you have obtained our express permission; or (4) such disclosure is required by law; and in each case only to the extent permitted and/or as necessary.

WHAT ARE YOUR PRIVACY RIGHTS?

The types of personal data we collect are listed in the “What Information Do We Collect?” section above. If we are relying on your consent to process your Personal Information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the “How Can You Contact Us About This Notice?” section below. However, please note that this will not affect the lawfulness of the processing of your Personal Information before its withdrawal nor when applicable law allows, will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

Your Privacy Choices (U.S.). You may have the right to: (a) know/access specific pieces and categories of Personal Information; (b) correct inaccuracies; (c) delete Personal Information; (d) opt out of the sale or sharing of Personal Information and of targeted advertising; (e) opt out of certain profiling; and (f) limit the use and disclosure of Sensitive Personal Information. You may exercise these rights by emailing contactus@innovativelanguage.com. You may also request deletion of your data at any time through the Delete Account function available through the “My Account” page in your user account. We will respond to your request within the timeframe required by law. Please note that we can only honor requests to opt out of disclosures on a going-forward basis and opt-out requests do not affect information that we have previously disclosed. We may also retain certain information about you as required by law or as permitted by law for legitimate business purposes.

Appeals. If we deny your request, you may appeal within 45 days by emailing contactus@innovativelanguage.com. We will respond to appeals within 45 days (or as otherwise required by law). If your appeal is denied, you may contact your state Attorney General.

YOUR STATE PRIVACY RIGHTS

Residents of certain states may have additional rights regarding their Personal Information under their state’s privacy laws. These rights may include the ability to:

  • Confirm whether we process your Personal Information and access it (including the categories, and in some states, specific pieces of Personal Information);
  • Access the categories of Personal Information we collect, use, disclose, or share (and, where applicable, the specific pieces of Personal Information);
  • Correct inaccuracies in your Personal Information;
  • Delete Personal Information we collected from you (and, in some states, Personal Information we obtained from other sources);
  • Obtain a portable copy of certain Personal Information you provided to us; and
  • Opt-out of:
    • Targeted advertising (cross-context behavioral advertising);
    • The “sale” or “sharing” of Personal Information (as defined by applicable law); and
    • Certain forms of automated decision-making or profiling (where applicable) that produce legal or similarly significant effects.

These rights are not absolute and may be subject to statutory exceptions. We will honor your privacy rights as required by the laws of your state of residence.

Exercise Your Rights. To exercise your rights, please submit a request by emailing us at contactus@innovativelanguage.com.

Verification and Authorized Agents. We will verify your request using information associated with your account or interactions with us and may request additional information only as reasonably necessary to confirm your identity or authority, as permitted by law. We will not require you to create an account to submit a request. If you submit a request through an authorized agent, we may require proof of authorization (for example, signed permission from you or a valid power of attorney). For requests to know/access, delete, or correct, we may also require you to verify your identity directly with us. For requests to opt out of “sale,” “sharing,” or “targeted advertising,” we will accept authorized agent requests upon sufficient proof of authority and will not require you to verify your identity directly as a condition of processing. We will not collect or use Personal Information beyond what is reasonably necessary to verify and process your request, and we will honor valid opt-out preference signals (such as Global Privacy Control) without additional steps.

California Privacy Rights. California residents have the additional right to:

  • Know the categories of Personal Information we have collected, the categories of sources, the business or commercial purposes for collection or sharing, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we maintain about you;
  • Opt-out of the “sale” or “sharing” of Personal Information for cross-context behavioral advertising;
  • Limit the use and disclosure of Sensitive Personal Information to what is necessary to provide requested services (if applicable);
  • Have us honor GPC signals as a valid opt-out request;
  • Receive information about financial incentives, if offered (we do not offer financial incentives at this time; if this changes, we will provide a Financial Incentive Notice describing the material terms and how to opt in).

Notice at Collection (California and similar laws).
We collect the following categories of Personal Information: Identifiers (e.g., name, email, IP address), Commercial Information (e.g., payment details, credit card information, and purchase or transaction history), Internet/Network Activity, General Geolocation Data, and Inferences. We collect these categories from you, your devices, our service providers, third parties (e.g., ad networks and analytics providers), and affiliate partners for the purposes described in the “How Do We Process Your Information?” section. We may disclose these categories to service providers and contractors for business purposes and may “sell” and/or “share” Personal Information for cross-context behavioral advertising and engage in “targeted advertising” as described in this Privacy Policy. We retain Personal Information for the periods described in the “How Long Do We Keep Your Information?” section.

“Shine the Light.” California Civil Code § 1798.83 permits California residents to request, once per year and free of charge, information about the categories of Personal Information (if any) we disclosed to third parties for their direct marketing purposes in the prior calendar year and the names and addresses of those third parties. To submit such a request, contact us using the information in the “How Can You Contact Us About This Notice?” section.

California Minors’ Content Removal. If you are a California resident under 18 and have an account on the Services, you may request removal of content you publicly posted by contacting us using the information in the “How Can You Contact Us About This Notice?” section and identifying the content. We will make the content no longer publicly visible on the Services, but complete removal (e.g., from caches or archives) may not be possible.

Financial Incentives. We do not offer financial incentives, price or service differences, or loyalty programs in exchange for Personal Information. If this changes, we will provide a Financial Incentive Notice describing the material terms, categories of Personal Information implicated, and how to opt in.

HOW TO REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT

Under applicable law, you or someone legally authorized to act on your behalf (your “Authorized Agent”), may make a request to access, correct or delete your Personal Information. You may, under applicable law, also make a request to know or delete Personal Information on behalf of your child (however, please note, we do not knowingly collect any Personal Information of anyone under the age of 16). Requests or exercise of your right(s) can be made by emailing us at contactus@innovativelanguage.com. For information on how we verify requests and process authorized agent submissions, please see the Verification and Authorized Agents provisions in the “Your State Privacy Rights” section.

You can also access, review, and change any of your personal profile information at any time from the Account Info section of the My Account page.

GOVERNING LAW

This Privacy Policy, and your access to and use of the Website and Services, as well as any dispute, claim, or controversy arising out of or relating to them, will be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law rules or principles (whether of Delaware or any other jurisdiction) that would result in the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or that cannot be heard in small claims court will be resolved exclusively in the state or federal courts located in New Castle County, Delaware and the parties consent to the personal jurisdiction and venue of those courts.

SEVERABILITY

If any part of this Privacy Policy is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect.

INTERNATIONAL USERS

If you access our Services from the European Economic Area (“EEA”) or the United Kingdom (“UK”) and GDPR/UK GDPR applies, this section governs. If there is any conflict between this section and other parts of this Privacy Policy, this section governs for those users and to that extent.

When this Privacy Policy refers to “Company”, “we”, “our” or “us”, it refers collectively to Innovative Language Learning USA, LLC which is responsible for your information as described in this Privacy Policy.

Legal Bases (EEA/UK). Where the General Data Protection Regulation (“GDPR”)/UK GDPR applies, we process personal data on the following legal bases:

  • performance of a contract: to provide and operate the Services you request, including account-related features and responding to your inquiries.
  • legitimate interest: to operate, secure, and improve the Services; understand audience engagement with content; prevent fraud and misuse; and promote our content and offerings, in each case balanced against your rights and interests.
  • legal obligation: to comply with applicable legal requirements and respond to lawful requests.
  • with consent: where required by law, including for certain marketing communications or the use of non-essential cookies or similar technologies. You may withdraw consent at any time using the methods described in this Privacy Policy.

EEA/UK Controller, DPO, and Representative. For users in the EEA/UK (to the extent applicable), the controller is Innovative Language Learning USA, LLC. We have not appointed an EU/UK representative or Data Protection Officer. We will update this Privacy Policy if that changes.

Categories of Data, Purposes, and Legal Bases. Depending on how you use the Services, and only to the extent applicable law requires, we may process:

  • Identifiers and contact information (e.g., name, email) to provide the Services and communicate with you (contract; legitimate interests); with your consent where required for marketing.
  • Internet/network activity and device data (e.g., IP address, device type, usage data) to operate, secure, and improve the Services, including basic analytics (legitimate interests); with consent where required for non-essential cookies or similar technologies.
  • Approximate location derived from IP address to tailor content and for security (legitimate interests). We do not collect precise geolocation unless you consent and your device settings allow it.
  • Inferences about content preferences to personalize Website content (legitimate interests); with consent where required for non-essential cookies or similar technologies.

Retention. We retain personal data only for as long as necessary to fulfill the purposes described above, including complying with legal, accounting, or reporting obligations. In determining retention periods, we consider the nature and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes of processing and whether we can achieve those purposes through other means, and applicable legal requirements. We also take into account typical user lifecycle and our need to maintain accurate business and financial records.

Recipients and International Transfers. We share personal data with service providers and processors as described in this Privacy Policy. If we transfer personal data from the EEA/UK to countries not deemed to provide an adequate level of protection (e.g., the United States), we rely on appropriate safeguards.

EEA/UK Rights. Where the GDPR/UK GDPR applies, you may have the right to request access to, rectification or erasure of your personal data, to restrict or object to certain processing, and to data portability, as well as the right to withdraw consent where processing is based on consent.
