Governor Kathy Hochul has signed the FY2026 New York State Budget expanding the NYS Film Tax Credit Program to $800 million annually (a 14% increase) and solidifying New York’s place at the center of the national production incentive race. But this isn’t just more funding-it’s a smarter, more strategic investment in the long-term health of our industry. Here’s what you need to know: • Production+ Program – First-in-the-nation initiative to reward recurring business • Additional 10% credit for producers with 2+ projects and $100M+ in NY spending • Indies can qualify with $20M+ spend for an extra 5% • Empire State Independent Production Program – A new $100M fund to help independent films monetize their credits sooner • 10% UPSTATE BUMP remains – Productions shooting in upstate NY continue to receive a 10% bonus on below-the-line labor, keeping jobs and economic impact flowing into communities across the region • Above-the-line individual cap removed – More flexibility for productions featuring high-profile talent • Extension through 2036 – Two more years of certainty for producers, investors, and studios • Credit payout accelerated – Eliminates multi-year tiers for new applicants, improving cash flow • Extra incentives: • 10% musical scoring bonus for productions using 5+ NY-based musicians • Post-production flexibility: Qualify with either $1M in spend or 75% of total post budget • Lower thresholds for VFX & animation (now 10% or $500K) • Regulatory change allows independent productions to apply for credits earlier These enhancements make New York State more competitive than ever, and signal a long-term commitment to growing our creative economy statewide.
